These Terms & Conditions ("Terms") govern your use of the Medihub Pharmacy website and our pharmacy services. By submitting any information through this website — including refill requests, transfer requests, contact forms, or other communications — you acknowledge that you have read, understood, and agree to be bound by these Terms.

Patient agent authorization

By submitting your information through this website, you authorize Medihub Pharmacy and its licensed pharmacy staff to act as your agent for the purpose of:

  • Contacting your previous or current pharmacy to request the transfer of your prescription(s);
  • Contacting your prescribing physician(s) or other healthcare providers to request new prescriptions, refills, prior authorizations, or clinical clarifications;
  • Contacting your insurance plan, pharmacy benefit manager (PBM), Medicare, Medicaid, or other payor to verify benefits, submit claims, request prior authorizations, and resolve coverage issues;
  • Receiving, processing, dispensing, packaging, and (where applicable) delivering your prescription medications;
  • Communicating with you and, where appropriate, with members of your care team about your prescriptions and pharmacy care.

This authorization is given voluntarily and may be revoked by you at any time, in writing or by contacting your local Medihub Pharmacy. Revocation will not affect actions already taken in reliance on the authorization.

New York State pharmacy law compliance

Medihub Pharmacy is licensed and regulated by the New York State Education Department, Office of the Professions, Board of Pharmacy. We operate in compliance with applicable provisions of:

  • New York Education Law Article 137 (Pharmacy);
  • Title 8 of the Official Compilation of Codes, Rules and Regulations of the State of New York (NYCRR), Part 63 (Pharmacy);
  • New York Public Health Law Article 33 (Controlled Substances) and the regulations of the New York State Bureau of Narcotic Enforcement (BNE);
  • The New York State Prescription Monitoring Program (PMP) registry requirements (I-STOP);
  • All applicable record-keeping, labeling, dispensing, and patient counseling requirements under New York law.

DEA & controlled substance compliance

Medihub Pharmacy is registered with the United States Drug Enforcement Administration (DEA) and complies with all applicable provisions of the Federal Controlled Substances Act (21 U.S.C. § 801 et seq.) and 21 C.F.R. Parts 1300–1321, including but not limited to:

  • Verification of the validity of all controlled substance prescriptions and the corresponding responsibility of the pharmacist;
  • Strict adherence to schedule-based dispensing limits, refill restrictions, and transfer rules;
  • Required record-keeping, inventory, and reporting (including ARCOS, where applicable);
  • Secure storage, handling, and disposal of all controlled substances.

Controlled substance prescriptions may be subject to additional verification, identification requirements, and dispensing limitations as required by federal and New York State law.

FDA compliance

Medihub Pharmacy dispenses only FDA-approved medications obtained from licensed wholesalers and manufacturers in accordance with the Federal Food, Drug, and Cosmetic Act (21 U.S.C. § 301 et seq.) and the Drug Supply Chain Security Act (DSCSA, Title II of the Drug Quality and Security Act). We comply with applicable FDA labeling, medication guide, Risk Evaluation and Mitigation Strategies (REMS), and adverse event reporting requirements.

PBM & payor guidelines

Where prescriptions are billed through insurance, Medihub Pharmacy participates in pharmacy networks administered by various Pharmacy Benefit Managers (PBMs) and payors, including commercial plans, Medicare Part D, and New York Medicaid Managed Care. By submitting your insurance information, you authorize us to:

  • Submit claims and adjudicate prescriptions through the applicable PBM or payor;
  • Apply formulary, prior authorization, step therapy, and quantity-limit rules required by your plan;
  • Disclose the minimum information necessary to obtain coverage determinations and resolve claim issues;
  • Comply with all PBM provider manuals, audit requirements, and applicable federal and state PBM transparency laws (including Article 29-AAAA of the New York Public Health Law).

You are responsible for any copays, coinsurance, deductibles, or non-covered amounts determined by your plan. If your medication is not covered, we will work with you and your prescriber on appropriate alternatives.

Insurance acceptance varies by location. The specific insurance plans, PBM networks, Medicaid Managed Care plans, and Medicare Part D plans accepted at each Medihub Pharmacy location depend on the current contractual status between that individual store and the plan or PBM. Network participation, in-network status, reimbursement rates, and accepted plans may change at any time without notice as contracts are added, renewed, renegotiated, or terminated. A plan accepted at one Medihub Pharmacy location may not be accepted at another, and a plan accepted today may not be accepted at a future date. Before transferring or filling a prescription, please contact your preferred Medihub Pharmacy location directly to confirm that your specific plan is currently in-network at that store.

SMS/Text messaging disclosure, privacy notice & terms of communication

This disclosure applies to Medihub RX Inc, Medihub Pharmacy Inc, Medihub Pharmacy, and all affiliated Medihub Pharmacy locations, operations, employees, representatives, contractors, and authorized communication vendors ("Medihub Pharmacy," "we," "our," or "us").

Communications you may receive. By providing your mobile phone number and opting into SMS/text communications from Medihub Pharmacy, you consent to receive recurring informational and healthcare-related text messages regarding:

  • Prescription refill reminders
  • Prescription status updates
  • Medication adherence reminders
  • Prescription transfer coordination
  • Delivery scheduling and notifications
  • Vaccine and immunization reminders
  • Pharmacist consultations and patient care communications
  • Insurance, billing, and account notifications
  • General pharmacy customer service and operational updates

Message frequency. Message frequency varies depending on your prescription activity, patient care needs, refill schedule, delivery requests, account activity, and interactions with Medihub Pharmacy. Recurring messages may be sent periodically.

Message & data rates. Message and data rates may apply based on your mobile carrier and wireless service plan.

Opt-out instructions. You may opt out of SMS communications at any time by replying STOP to any text message received from Medihub Pharmacy. After opting out, you may receive one final confirmation message confirming your removal from text messaging services.

Help & support. Reply HELP for additional information or assistance. You may also contact your local Medihub Pharmacy directly for support regarding your communications or pharmacy services.

Consent & communications. By opting into SMS communications, you authorize Medihub Pharmacy and its authorized service providers to contact you using automated technology, autodialers, or non-automated methods consistent with the Telephone Consumer Protection Act (TCPA), applicable FCC regulations, and state telecommunications laws.

Consent is not a condition of purchase. Consent to receive text messages is not a condition of purchasing goods, receiving prescriptions, or obtaining healthcare services.

HIPAA & privacy compliance. Medihub Pharmacy is committed to protecting your personal information and protected health information ("PHI") in accordance with the Health Insurance Portability and Accountability Act ("HIPAA"), the HITECH Act, applicable New York State privacy laws, and other applicable healthcare privacy regulations. Text messages may contain limited healthcare-related information necessary to provide pharmacy services and patient care. Standard SMS/text messaging may not always be encrypted and may involve certain security risks. By opting into SMS communications, you acknowledge and accept these risks.

FTC & data privacy compliance. Medihub Pharmacy complies with applicable Federal Trade Commission (FTC) consumer protection and privacy requirements. We do not sell, rent, lease, or share your mobile number or personal information with third parties for independent marketing purposes. Your information may only be used or disclosed as permitted by law for healthcare operations, prescription processing, patient communications, insurance processing, regulatory compliance, and pharmacy services.

Privacy policy & terms and conditions. By opting into SMS communications, you acknowledge and agree to Medihub Pharmacy's Privacy Policy and Terms & Conditions. Wireless carriers are not liable for delayed or undelivered messages.

Phone call communications disclosure, privacy notice & terms of communication

This disclosure applies to Medihub RX Inc, Medihub Pharmacy Inc, Medihub Pharmacy, and all affiliated Medihub Pharmacy locations, operations, employees, representatives, contractors, and authorized communication vendors ("Medihub Pharmacy," "we," "our," or "us").

Communications you may receive. By providing your phone number and opting into phone call communications from Medihub Pharmacy, you consent to receive recurring informational and healthcare-related phone calls regarding:

  • Prescription refill reminders
  • Prescription status updates
  • Medication adherence reminders
  • Prescription transfer coordination
  • Delivery scheduling and notifications
  • Vaccine and immunization reminders
  • Pharmacist consultations and patient care communications
  • Insurance, billing, and account notifications
  • General pharmacy customer service and operational updates
  • Promotional & marketing related to Medihub Pharmacy

Call frequency. Call frequency varies depending on your prescription activity, patient care needs, refill schedule, delivery requests, account activity, and interactions with Medihub Pharmacy. Recurring calls may be made periodically.

Opt-out instructions. You may opt out of phone call communications at any time by contacting your local Medihub Pharmacy directly and asking to be removed from automated or live outreach lists. After opting out, you may receive one final confirmation communication confirming your removal from phone call services.

Help & support. For additional information or assistance, contact your local Medihub Pharmacy directly or email info@medihubpharmacy.com for support regarding your communications or pharmacy services.

How customer consent is obtained. Medihub Pharmacy obtains customer consent for phone call communications through one or more of the following methods:

  • Verbal consent provided in person at a Medihub Pharmacy location
  • Verbal consent provided over the phone with pharmacy staff
  • Online website forms completed by the patient or authorized representative
  • Prescription registration, transfer, refill, delivery, or patient intake forms
  • Electronic consent forms or digital registration systems
  • Written consent provided on pharmacy documents or patient communication forms

By voluntarily providing a phone number and requesting pharmacy services, the patient or authorized representative acknowledges and agrees to receive recurring healthcare-related and operational phone calls from Medihub Pharmacy as described in this disclosure.

Medihub Pharmacy maintains records of consent where required by applicable law, telecommunications regulations, carrier requirements, and healthcare compliance standards.

Customers may withdraw consent at any time by contacting Medihub Pharmacy directly or by asking to be removed from phone call communications during any call.

Vaccination & immunization availability

Medihub Pharmacy offers a range of immunizations through our licensed and certified immunizing pharmacists in accordance with New York Education Law and applicable state and federal requirements. Vaccine availability is not guaranteed and varies by location.

  • Not every vaccine is offered at every Medihub Pharmacy location. The specific immunizations available depend on each store's inventory, refrigeration capacity, certified immunizer staffing, scheduling availability, and current state authorization.
  • Vaccine inventory is subject to manufacturer supply, seasonal availability, cold-chain requirements, and recall or expiration events, and may be out of stock at any time without notice.
  • Pharmacist-administered immunizations are limited to the patient age groups, vaccine types, and clinical conditions authorized by New York State law and the pharmacist's certification. Vaccines outside that scope must be obtained from a physician or other authorized provider.
  • All vaccinations require a pre-administration screening. Your request may be denied, delayed, or rescheduled — and the pharmacist may decline to administer a vaccine — based on the screening, contraindications, recent vaccinations, allergies, pregnancy status, current illness, lack of required identification or consent, insurance or payment issues, or the pharmacist's independent professional judgment.
  • Insurance coverage for a given vaccine varies by plan and by location's network status (see the section above). You may be responsible for the full cash price of any non-covered vaccine.

Before traveling to any Medihub Pharmacy location for an immunization, please call ahead to confirm that the specific vaccine is in stock, that an immunizing pharmacist is on duty, and that your insurance is accepted at that location.

No medical advice; pharmacist judgment

Information provided through this website is for general informational purposes only and does not constitute medical advice. Our pharmacists exercise their independent professional judgment and may decline to fill a prescription that, in their professional opinion, would be unsafe, unlawful, or inconsistent with the standards of practice. General terms

Eligibility. You must be at least 18 years old, or the parent/legal guardian of the patient, to submit information through this website.

Accuracy of information. You agree to provide accurate, current, and complete information. Inaccurate information may delay or prevent us from providing pharmacy services.

Limitation of liability. To the fullest extent permitted by law, Medihub Pharmacy and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of this website. Nothing in these Terms limits any liability that cannot be excluded under applicable law.

Governing law. These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in New York.

Changes. We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
